Following his suicide, Nally's parents filed a wrongful death suit against their son's fundamentalist church, alleging that its pastoral counselors had failed to steer him toward the professional help they thought he needed and even dissuaded him from seeking secular help. Nally v. Grace Community Church of the Valley was the nation's first case to allege "clergy malpractice," one that challenged the freedom of religious leaders to counsel their parishioners. Initially dismissed on religious freedom grounds, the parents' suit was twice reinstated by an appeals court, only to be overturned by a unanimous vote by the California State Supreme Court in 1988. But that decision was made on very narrow grounds, leaving open the likelihood of future court challenges.

As told by Weitz, the Nally case is as much a story of modern America as it is an account of courtroom proceedings. By examining both the rise of the fundamentalist movement in the Los Angeles area in the 1960s and 1970s and the social pressures with which Kenneth Nally struggled, he reveals how a culture based on personal achievement came into direct conflict with one based on the search for salvation. He also shows the difficulty of deciding a case in which the competing claims--religious freedom and professional accountability--both rest on key principles revered in American society.

Based on interviews with participants on both sides of this drama, as well as extensive research in public records, Weitz provides a compassionate, fair-minded, and illuminating account of a very difficult case with unpredictable ramifications for the future.

When it came time for me to talk, I wasn’t sure which parts of my past to tell, which to keep secret, and which to pretend never happened. He got really quiet and started balling and unballing his fists.

I continued my update. Experience had taught me that adults have trouble accepting the idea of children having sex. I decided that from then on, that part of my life never happened. I picked up the story by telling them about Fly, the Gangstas, and getting shot.

I was dying for a cigarette. So it seemed a good time to announce that I smoked cigarettes—and weed.

After a moment Sam looked at me, smiled, and handed me one of her Marlboros. I preferred menthols, but beggars can’t be choosers. I kicked back, took a long drag, and closed my eyes.

Daddy and Jr. were silent. They seemed a bit shocked and unsure about how to respond.

“Well, Cup,” Jr. said, “it’s a little too late to be trying to raise you now. But those cigarettes will kill you. And weed will only lead you to stronger drugs.”

He didn’t know how right he was. But for me, it was too late to be worrying about stronger drugs—the only worrying I did was whether I could find a connection to get some. So I just smiled, nodded, and took another hit off my cigarette.

The eerie quiet returned.

To understand the magnitude and scope of what constitutes a crime and why, we must look to the past and the nature of our society and its theoretical and sociological. The theory of philosophy and politics is most compelling short speech of Plato's theory of John Locke and Thomas Hobbs. Plato discussed the company and thought, Reason and Utopia, in other words, how can we create a society perfect and idyllic, which was held in Le Mansthe company?

Locke and Hobbs were thinkers who were very influential on the founding fathers of our country when they drafted the U.S. Constitution. Locke and Hobbs said that people are born in a "state of nature", which means anarchy, no rules and no government. What does this mean?

For example, say, a thousand people of all ages, sizes, education, races and religions were thrown on an island with limited resources and no government, rules,or laws. What would happen? Would everyone be treated equally and be supported? Would they be clothed, fed and protected? Would the inherent goodness of people come shining through the best interests of all? Well, according to Locke and Hobbs and many others, something else would happen. "Human Nature" and take over Darwinian "survival of the fittest" would prevail.

The strong take the weak and the Horde resources for themselves. Dominant groups,say seven hundred thousand were of the same race and religion. They probably would ban together and enslave others. If there were ten equal groups, they may war among themselves with the most powerful groups to become dominant.

Without laws, people could kill, rape, rob, beat and enslave with impunity, the Platos Utopia "would find anything. So what happens? How and why corporations formed? The answer, according to Locke and Hobbs, is the creation of a social "Contract ".

A "social contract" is where individuals "give up" certain "rights", for they have other "rights" to live in peace and freedom in a society. Let us return to our island of a thousand. Let's say everyone has a little food and shelter and enjoys being alive. However, in a "state of nature" of each individual is free to do what they wanted to act. They could take another "property by force, and if they did not like someone they could kill themholding company or surgery. It is not desirable to any individual or group unless they are strongest.

Instead, every thousand get together and form a social contract that on this island, the individual will waive their right to kill and steal from others, if others waive their right to steal and to kill the individual and society is formed and a "rule of law prevails.

Now we have discussed in theory, why Hobbsian "state of nature"is not desirable and therefore a "social contact" and the formation of a company with the "rule of law" is beneficial and why people are willing to "give up" certain "rights" to "profit" of other "rights" that will make the quality and life expectancy greater.

In our example, the island, two acts or crimes, murder, and theft have been illustrated. One murder is a crime against a person, the second theft is a crime against property of a person. These are the easiest. In any society base, they areunderstood as being against the laws of the community. They reflect our commitment as individuals and as a group free from the tyranny of others.

Before going further, we must understand why a market of social work. Social contact works because everyone "in" society accepts it. It can be and is probably written down, but not the writing that makes it powerful is the agreement.

Consider another example. In Los Angeles, we have trafficlights. It is clearly written in the California Vehicle Code that, fundamentally, green means "go", red means "stop" and yellow means "caution, proceed to the stop". You've probably never seen a code vehicles and almost certainly do not know the numbers section of code violations for fire, but we all know what these lights.

These lights do not work because we are all agreed, as part of an inclusive social contract to obey these rules. There is no universal physical propertyon a red light that makes us stop, or a green light that makes us go. These could easily evolve in different colors. It is not that there is the code section stating that we must stop at a red light that we, in fact, stop.

If everyone in Los Angeles has decided to "run" red lights all the time, there are not enough police or the courts to do something. The reason we stop at red lights is so that we will not be killed or injured duringour daily lives. The reason we go into the green because we believe it is generally safe. We do this not only for the safety of us, but for the safety of those we love and care about. We also do it for practical reasons. Imagine Los Angeles with all its vehicles and no traffic lights. You must have three days to cross the city and you could get to your destination alive and uninjured. We do believe we obey fire because of not doing so is against thelaw.

If you think so, let us look at the yellow light. What this means is entitled "Caution, prepare to stop" but many people who adhere to the social contract process light yellow like "Keep Going" or even "faster!" As Shakespeare might have said that the yellow light, it is a "rule observed more in its breach." The same could be said for many stop signs in Los Angeles and the advent of "California rolling stop."

Most people chooselive in the Social Contract. These are people who choose to act or live outside the social contract that our laws dealing with tax crimes.

We live in a society full of rules and laws of evidence, murder, rape, robbery, arson and ridicule, no cats in the park. Most of us do not even know how many laws and rules that we comply at all times. In what direction we park our cars in the street and how far from the border as examples. Weclassified in the wiring of our homes standards on roofs. . We are restricted in the way we play our music hard and when, to where we can ride our bikes and our children must sit as formal laws, the five-day week of work than Other more informal.

Social contact and our laws change as society evolves. Domestic violence was considered a "private matter". Drunk drivers were aloud "sleep off" and go home. These have clearly changed andbecome more serious crimes. The regulation of prescription drugs and how our companies do their accounting are other recent examples of how the laws of our society are constantly evolving and changing.

Our current social contract also makes the criminal justice system the "dumping ground" for many health problems of the corporation. Mental illness and substance abuse, health issues are now clearly social as crimes and channeled by the courts andprisons.

This article has illustrated some of the reasons that explain the evolution of modern crime and why we have crimes. There, federal, provincial and local laws contained in the codes as California Penal Code that lists all state crimes and their elements. Persons who violate these laws are often arrested and charged because they act outside of our social contract and violate the laws of our society. Understand that, despite statistics showing the high crime rate per capitabasic crime is low because most people adhere to the social contract and choose not to violate its laws.

Remember, there are not enough police or courts to handle the volume if everyone broke the law. If everyone with marijuana in California, which show both at their local police station, the system would collapse. The laws are intended and essentially a form of public policy in the form of safety regulations with punitive measures for the vast majority can live inpeace. This is our social contract and they answer to why there are crimes. Do you live in peace?
